PROGRAM GUIDELINES

Starting 15th April, 2016, Program policy of The Upper Crest program will change. To enable a smooth transition we have listed down points to be noted for your perusal:

• Starting 15th April, 2016, every loyalty point you earn by shopping at exclusive Louis Philippe store will be valued at 50 paisa (1 point = Re.0.50). The point revaluation is applicable to members at all tiers i.e, Silver, Gold & Platinum.
• The Loyalty points earned by Silver, Gold & Platinum members from 15th April, 2016 onwards will be valid for a period of One (1) year from the date of issue.
• Louis Philippe will honour any points that members are holding prior to 15th April, 2016 at Re 1(1Point = 1Re) till 15th June, 2016. Members of all tiers are requested to redeem their points on or before 15th June, 2016 to avoid devaluation of current points.

The above terms and conditions apply to all registered members of ‘The Upper Crest’ rewards program by Madura Garment a division of Aditya Birla Nuvo Limited (‘MG’) whose registered office is at Indian Rayon Compound, Veraval, Gujarat. Every member agrees to abide by these Terms and Conditions when shopping at Louis Philippe stores. As a member of ‘The Upper Crest’ rewards program you agree to these Terms and Conditions.

• Special Styling assistance by our experts.
• Exclusive invite to our store events.
• Special Preview to our End of season sale.
• Special Birthday privileges.
• Earn reward points on all spends.

MEMBERSHIP BENEFITS

• To receive points you must share your mobile number at the time of purchase. Points are awarded only for goods purchased and paid for.
• MG and their participating vendors will determine from time to time which goods qualify for points and the number and value of points that will be credited for purchase of such goods. The Upper Crest membership is only applicable and valid for purchases at Louis Philippe stores and the participating vendors, and points will only be earned for purchases made at the Louis Philippe stores and the participating vendors covered under the program.
• Any inaccuracies brought to the notice of MG within the prescribed time will be verified and a decision taken related to the alleged inaccuracies will be communicated to the member and such decision shall be final and binding.
• The points earned cannot be pooled with the points earned by any other The Upper Crest member. Points would expire one year after the date of issue. No claim for redemption of reward points will be entertained after the expiry period.
• Points cannot be redeemed for cash value and can be redeemed only for goods. Points cannot be sold, transferred or otherwise dealt with except in accordance with the Terms & Conditions of this agreement.
• A maximum of up to 99% of the bill value can be redeemed through Loyalty points. 
• All decisions relating to your membership or points are at MG’s sole discretion.

LIABILITY

You are deemed to be responsible for, and shall use your own skill and judgment as to, the quality, value and suitability of such information and suggestions in relation to deciding membership and purchase of products. MG hereby disclaims any and all liability for any act omission of any vendor or any loss incurred by you as a result of any act or omission of a vendor. MG accepts no liability for any loses or claims arising from any inability to access the Site or any failure to complete a transaction. MG shall not be liable for any loss, cost, expense or damage of any nature whatever (whether direct or indirect) resulting from the provision of the services or your reliance upon the information and suggestions provided by MG. MG shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from dealings with our participating vendors or MG. MG’s maximum liability to you for breach of any of its obligations hereunder shall be limited to the value of the product purchased. MG aims to ensure that viruses (or other programs having adverse effects) do not reside on the Site, but MG accepts no responsibility in relation to this. This section applies The Upper Crest membership program are solely between the member, as a customer, and the participating vendor, as a seller of the product or service. MG has no responsibility or obligation with respect to purchase or sales (including no responsibility or obligation for disputes between an individual member and any participating vendor). Accordingly, in consideration for MG making the The Upper Crest program available to members and participating vendors, who make sales or purchases through the The Upper Crest program acknowledge and agree that under no circumstances shall MG be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from, or arise out of the purchase, sale or use of any products or services purchased or sold. All conditions and warranties, whether expressed or implied and whether arising under legislation or otherwise, as to condition, suitability, quality, fitness or ward supplied, are expressly excluded to the fullest extent permitted by law. Any liability that cannot be fully excluded is limited to replacing, repairing or crediting the value of the reward at our sole discretion. Safety of any reward supplied, are expressly excluded to the fullest extent permitted by law. Participating vendors and reward providers do not have any authority, expressed or implied, to make any representation or warranty on our behalf.

CHANGES IN TERMS AND CONDITIONS

Membership is not transferable and may only be used by each member who enrols in the program. MG reserves the right to modify the structure, benefits, and other features, of the program including these terms and conditions or to terminate the program at any time. Although MG will use reasonable efforts to notify members of material changes, it is the responsibility of members to keep themselves up to date in respect of all the terms and conditions of the The Upper Crest program. Any use of the program by a member will be deemed as acceptance of any amendment. MG will not be liable for loss or damage resulting there from.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by the laws of Republic of India and are subject to the exclusive jurisdiction of the courts in Bangalore. The provisions of the ‘Privacy Policy’ shall apply at all times.
